H.R. 8460, the Territorial Protection and Sovereignty (TPS) Act, introduced by Georgia Congressman Andrew Clyde, would repeal the Temporary Protected Status (TPS) authority entirely. It would terminate all existing TPS designations and require TPS holders to depart the United States, as they would no longer be considered lawfully present and would become eligible for deportation.
This bill is long overdue because TPS, originally intended as a short-term humanitarian measure under the 1990 Immigration Act for countries facing temporary crises like armed conflict or natural disasters, has been widely abused for decades. Designations have stretched on for 16–34 years in many cases, effectively creating permanent backdoor amnesty and work authorization for over one million migrants—expanded further in recent years—while undermining congressional control over immigration and prioritizing foreign nationals over the safety, prosperity, and futures of American citizens.
